Reasons for the enactment

Under articles 267 (2) and 283 (2) of the Constitution,
the Assam Contingency Fund Act, 1950 was enacted pro
viding for the establishment of a Contingency Fund of the
State of Assam and to provide for advances to be made out
of it for the purposes of meeting unforeseen expenditure.
Under Section 3 of that Act, as amended, the corpus of the
Fund is Rs. 5 crores. Of this, Rs. 4 11 crores had been drawn
upon till the end of March, 1980 and, therefore, the resi
duary balance has become totally insufficient: for meeting
expenditure on unforeseen items especially those per
taining to law and order, rehabilitation of the people
affected by disturbances, etc., and other post-budget
commitments. To meet these, the Bill seeks to raise tem
porarily the corpus of the Fund to Rs. 15 crores until the
31st day of March, 1981.

2. In view of the urgency of the matter, it is not prac
ticable to consult the Consultative Committee of Parlia
ment on Assam Legislation. The measure is accordingly
being enacted without reference to the Consultative
Committee.
