ACT 

further to amend the Assam Cooperative Societies Act, 2007 . 

Whereas it is expedient to amend the Assam Coopera!ive 
Societies Act, 2007, hereinafter referred to as the principal Act, in 
the manner hereinafter appearing; 

It is hereby enacted in the Seventieth Year of the Republic 
of India as follows :-

Short title, extent and I . (I) This Act may be called the Assam Cooperative So<.:i('ti~s 
commencement (Amendment) Act, 2019.

(2) It shall have the like extent as the principal Act. 

(3) It sh~l; ·~ome into force at one..-:. 

2. kl the principal Act, in section. I 0, in sub-section (I), in 
cla~se (e), for the existing prevision, the following shall be 
substituted, namdy :-

"( e) a copy of treasury challan or proof of electronic payment 
as an evidence in support of payment of registration fee 
calculated as per the provisions of sub-section ( 1) of 
section 17 which shall be non-refunclahle." 

3. In the principal Act, in section 17, in sub-section (I), ii1 
between the word "challan" and "along", the words and 
punctuation marks "or hy electronic payment, as the case may 
be," sha II b~ inserted. 

4. ln the principal Act, in section 3 I, atter the word "year" 
appearing at the end, the words "frnrr. the date of election of the 
bin:ctors" shall be inserted. 

5. In the principalAct, in section 33, in suh-section (4), for the 
words "tnis bye-laws" appearing in between the words "prcivided 
in" and the punctuation mark",", the words "the hyc-·laws" shnll 
be substituted. 

6. In the principal Act, in section '.15, in sub-section (2), for the 
words "fifteen numbers of Directors" app~~ring in b~twee11 the 
words "consist of" and the punctuation mark " : " , the words 
''maximum twenty one number of Directors'~ shall be substituted. 

7. In the principal Act, in section 40, in sub-section (4), for thr 
existing provisions of clauses ( c) and ( e) , the following shn II be 
substiu~ted, namely :-

"(~) not conduct111g the meetings of the Board under sub-section 
(3) of section 43 or delegates or representatives tinder sub­
section (4) of section 41 :'' 

"( e) autbmti<ic dissolution under ~ub· section ( 4) of seci!i'.ln 41 ;".

8. In the principal Act, in section 84, in clause. {h), for the words 
"laid before the. Assam Legislati,·e Assembly" appearing in 
between th' words "shall be" and "by'' . the words "submitted to 
the State Govemh1ent", and for the figure and word" "120 days'' 
&ppearing in between the words 1'expiry of' and "days" • the 
figure and word "210 days" respectively. shall be substituted. 

9. In the principal Act, in section I 00, in sub-section (5), for the 
punctuation nrnrk "." <.ppearing at the e:1d, the puncll.latio11 mark 
'':" shall be c;11bstituted and there::tfter the following provis0s 
shall be insertt!d, namely:-

"Provided that for reasons beyond the control of the 
liquidator. more time is required for completion of the 
liquidation proceeding. the Rcgist.-ar. for reasons to .Ce recorded 
in writing with ,1deq11<1te justification, rnay grant an extension of 
the time ~hown in tht: certificatf of dissolution which shall not 
exceed one year beyond tile period of eight years from the date 
of appointment of the liquid a tor. 

Provided further that if the dissolution could not he 
effected within the exten<led period of one year for reasons 
peyond the control of the lic:uidator and further e-.<tension of 
time is necessary under compulsive circumstances1 the matter 
shall be referred by the Reg:strar to the Government in the 
Administrative Department. for further extension of ~irne. which 
shail not exce~d one year at a time or for arriving at r; decision to 
effectuate the dissolu1ion m a time b:wnd 'lianner, as mqy be 
deemed fit <ind prope.-."
