Ao Act to provide for adjudication of ntatt1:rs relating to rent by a Tribunal and
to promote leasing of accommodation by balancing the interests of landlords and tenants.
Be it enacted by the Chhattisgarh Legislature in the Sixty-second year of the Republic '

of India, as follows : -
Short title, extent I. ()) This Act may be called the Chhattisgarh Rent Control Act, 20 I I .
and commence-
ment.

Definitions. 2. In 1his Act, un les~ the context otherwise requires,-
( I) "Accommodation" means any building or part of a building. whether

(2) '·Agn.:emeni'· means the wnuen agreement executed by 1he landlNcl and 1he
tenant as required under th1~ Act,
(3) '"Di:.trict'' mt:an~ the district as construed in Chhauisgarh Land Revenue Code.

(4) "Habitual Defaulter" means a tenant who fails in a period of 12 months on
three or more occasions 10 pay in l'ull the rent and all dues to the landlord on
the due date in accordance wi1h the agreemen1;
(5) "Landlord'" means a person who for the Lime being is receiving or is entitled
10 receive, the rent of any accommodation, whether on his own account or on
account of or on behalf of or for the benefit of any 01her person or as a trustee,
guardian or receiver for any other person or who wou ld so receive the rent or
to be entitled to receive the rent, if the accommodations were let to a ll!nanl;
(6) "Mun icipal area" means the Municipal area or Nagar panchayat area as
defined under Chhauisgarh Municipal Corporation Act, 1956 (No. 23 of 1956)
or Chhallisgarh Municipalities Act, 1961 (No. 37 of 1961 ). as the case may
be;
(7) "Notification" refers to the relevan1 notification of the Government as
published in the Official Gazette;
(8) "Old Act" means the Chhauigarh Accommodation Control Act, 1961 (No.
XLI of 1961) with all amending acts;
(9) "Rent" means the consideration payabte-by the tenant ro tiJe,landioraa-gain:.!

(10) •.:Rent Controller'.' means the offic;:ial s9.appointed under sub-section (l) of
Section 7 of the Act;
(11) "Rent Control Tribunal" means th; body co~stituted un<ler Section 6 (1) of
the Act; , '
(12) "Repealed Act" refers to C~haVtisgarh Accommodation Control Act. 1961
(No. XLI of 1961) with all amending acts up to the date of selective repeal
vide Section 10(1) of this Act; ·
(I 3) ''Social Nuisance" means a tenant who frequently uses the accommodation
to commit any or all of the acts Ii.s led in serial No. IO of the Schedule 4;
1 (14) "Tena nt" means-
~ .
(i) the person by whom or on whose account or behalf rent is, or but
for, a contract express or implied, would be payable for any
accommodation to his landlord including the person who is
continuing its possession after the termination of his tenancy
otherwise than by an order or decree tor ev1ct1on passed under the
provisions of this Act; and

(ii) in the event of death of the person referred to in sub-clause (i) -

(a) in case of accommodation let out for residential purposes,
his 'surviving spouse, son, daughter, mother and father

commodation as member of his family up to his death;

mother and father who had been ordinarily carrying on
business with him in such accommodation as member of
his family up to his death.
Nothing in this Act shall apply to.- Exemptions.
( I) Any· accomm odation belonging to or owned by any department of Govern-
me nt a nd/or Board and/or Corporation promoted by and/or owned by the
Govern me nt.
(2) Any other building and/or category of building(s) specifically exempted in
public interest by the Government through notification.
4. ( 1) Notwithstand ing anything contained in Section I07 of the Transfer of Tenancy Agreement.
Property Act, 1882 (Central Act 4 of I 882), no person shall, after the
commencement of this Act, let or take on rent any accom modation except
by an.agreement in writing.
(2) Where, in relation to a tenancy created before the commenceinent of this
Act,-
(a) an agreement in writing was already entered into shall be filed be-
fore the rent Controller.
(b) no agreement in writing was entered into, the land lord and the ten-
ant shall en ter into an agreement in writing with regard to that ten-
ancy and file the same before the Re nt Controller;
Provided that where the landlord and the tenant fail to
present jointly a copy of tenancy agreement under ~au~e (a) or
fail to reach an agreement under clause (b) such land lord and the
tenant s hall separately file the particulars about such tenancy.

(3) Ev.ery agreement referred to in sub-secti6n (1) or required to be executed
under sub-section (2) shall be~ such fonnat and in such manner and within

of this Act, be such as may be agreed upon between the landlord and the
tenant and it shallrot include the charges payable for amenities which may

Tribunal :
Provided, however, that all cases pending before any court or au-
thority immediately before the. establishment of the Tribunal., shall con-
tinue to be processed under the old Act, as amended from time to time.

(3) Any proceeding before the Rent Control Tribunal or Re nt Controller shall
deemed to be a judicial proceeding within the meaning of Sections 193 and
228 and for the purpose of Section 196 of the Indian Penal Code, 1860
(Central Act 45 of 1860) and the Re nt Controller shall be deemed to be a
Ci vi i Court for the purposes of Section 195 and Chapter XX.VI of the Code
of Criminal Procedure, l 973 (Central Act 2 of 1974).

(3) Every landlord shall have obligations according to Schedule 3. The Tribunal
and Rent Controller(s) shall act at all times to enforce upon the landlord these
obligations.

and Rent Controller(s) shall act at all times to enforce upon the tenant these
obligations.
(5) Any willful attempt or act by the landlord to undermine or deny to the tenant
the rights available to him in terms of Schedule I shall constitute an offence
under this Act, punishable with fine not exceeding Rs. 5000 or simple im-
prisonment for a period not exceeding three months or both.
(6) Any willful auempt or act by the tenant to undennine or deny to the landlord
the rights available to him in terms of Schedule 2 shall constitute an offence

(2) The repeal under sub-section (I) shall not affect the previous operation of this
enactment so repealed and anything done or action taken or deemed to have:
been done or taken (including any appointment or delegation made, notifica-

sions of the repealed enanctment shall, so far as it is not inconsistent with
provisions of this Act, be deemed to have been done or taken under the provi-
sions of this Act and shall continue in force unless and until suspended by
anything done or any action taken under this Act.

on the condi tion that the accommodation will not be leased out at a higher rent for at least

THE CHHATTISGARH RENT CONTROL (AMENDMENl)
ACT, 2014
An Act further to a mend the C hhattisga rh Rent Control Act, 2011 (No. 19 of2012).
Be it enacted by the Chhattisgarh Legislature in the Shry-fifth Year of the Republic of
India, as follows:-
I. ( I) This Act may be called the Chhanisgarh Rent Control (Amendment) S hor1 1itle, u 1cn1
Act,2014. and commrn crmt n l.
(2) It shall extend to the whole State of Chhattisgarh.
(3) It shall come into force from the dare of its publication in the OITieial Gazelle.
For sub-section (2), (3) and (4) of Section 6 of the Chhattisgarh Rent Cont rol Amendment of
2. ( I)
Srclion 6.
Act, 2011 (No. 19 of 20 12), (hereinafter referred to as the Principal Act),
the fo llowing shall be substituted, namely:-
"(2) The State Government shall appoint the Chairman ofthe Rent Control
Tribunal, a retired Judge of the High Court or serving or retired
Distri ct Judge not below the rank of Super Time Scale.
(3) The Tribunal shall have such members wi th such qua lification, as the
State Government may prescribe.
(4) The State Government shall appoint jn officer as the Registrar of the
Tribunal, who shall not be below the cadre of Civil Judge Class-I or
the rank of Deputy Secretary to the State Government."

(2) After sub-section (5) of Section 6 of the Principal Act, the following shall be
added. namely :-
"(6) The Tribunal shall have its headquarters at Raipur and the State
Government may, by notification, fix such other places for hearing of
matters by the Tribunal, as it deems fit.
(7) The terms and conditions of the service of the Chairman and members
of the Tribunal shall be such as may be prescribed by the State
Government."
Insertion or new 3. After Section 13 of the Principal Act, the followi ng shall be added, namely:-
Section I 3-A.
" 13-A. Power to make rules.- (I l The State Government may, by notification in the
Official Gazette, make Rules ro carry out all or any of the purposes of this Act.
(2) Every Rule made under this Act shall be laid as soon as may be after it is made
before the House o f the State Legislature whi le it is in session, for a total period of thirty
days, which may be comprised in one session or two or more successive sessions and if,
before the expiry o f the session in which it is so laid or the session immediately fo llowing,

the House agrees in making any modification to the Rule or the House agrees that the

Rule should not be made, as the 1.:ase may be, and notifies such decision in the Official
Gazette, the Rule shall from the d::ite of pub lication of s uch notification have effect only

modification or annulment shall be without prej ud ice to the validity of anything

In
Amendment or 4. In Serial N umber 2 of Schedule 3 of the Principal Act, for the words " Form C" the words
Schedule 3. ··such proforma as may be prescribed'' shall be substituted.
Repeal. 5. The Chhatt isgarh Rent Control (Amendment) Ordinance, 2014 (No. 3of20 14) is hereby,
repealed.
